This Privacy Policy and Terms of Use ("Policy") applies to dominiquerealtor.com and all pages, forms, and seller programs operated by Dominique Bandet PREC ("we," "us," "our"), a licensed real estate professional registered with the BC Financial Services Authority (BCFSA), operating under Sutton Group West Coast Realty and a member of the Victoria Real Estate Board (VREB) and the Canadian Real Estate Association (CREA).

This Policy is separate from and supplemental to the platform-level privacy policy at realtormls.properties/site/privacy-terms, which governs IDX property search and the realtormls.properties platform. If you arrive through a seller program page on dominiquerealtor.com, this Policy applies.

By submitting information through any form on this website, you acknowledge that you have read and understood this Policy.

When you submit a form on this website, we may collect:

• Full name (first and last)
• Phone number
• Email address
• Property address (including geographic coordinates where Google Maps autocomplete is used)
• Stated selling timeline or program interest
• Any additional information you voluntarily provide in message or notes fields
• Date, time, and source of your submission (including UTM campaign parameters where present)

We do not collect payment card numbers, government identification, Social Insurance Numbers, or financial account details through any form on this website.

We use the information you provide solely to:

• Contact you to discuss your property and the seller program you inquired about
• Schedule and conduct an in-person property walkthrough and follow-up strategy session
• Prepare program-specific materials, including written guarantee terms and market analyses
• Communicate with you through automated follow-up sequences in our licensed CRM system (Lofty/Chime), which may include emails and SMS messages related to your inquiry
• Track campaign performance internally (source and UTM data only — never shared externally for advertising purposes)

We do not use your information for unrelated marketing, and we do not sell, rent, or trade your personal information to any third party for their own marketing purposes.

Your information may be shared only with:

• Third-party cash buyers who participate in the Cash Offer Program, solely for the purpose of preparing and presenting a written offer on your property. These parties are subject to confidentiality expectations consistent with BCFSA real estate trading standards.
• Sutton Group West Coast Realty, as the supervising brokerage, where required by BCFSA regulations or brokerage policy.
• Lofty Inc. (our CRM provider), as a data processor acting on our behalf. Lofty's own privacy policy governs their data handling practices.
• Google LLC, in connection with the Google Maps Places API used for address autocomplete. Google's handling of this data is governed by Google's Privacy Policy at policies.google.com/privacy.
• Legal, regulatory, or law enforcement authorities if required by applicable law, BCFSA order, or VREB/CREA standards.

We do not share your information with any party not directly involved in the real estate transaction process without your explicit consent.

By submitting a form on this website, you consent to being contacted by Dominique Bandet PREC by phone, email, and/or SMS regarding your inquiry and the applicable seller program.

You may withdraw consent at any time by contacting us at info@dominiquerealtor.com or by replying STOP to any SMS message. Withdrawal of consent does not affect the lawfulness of any processing carried out before withdrawal.

We retain your personal information for as long as is reasonably necessary to fulfill the purpose for which it was collected, or as required by applicable law and BCFSA record-keeping requirements. If no transaction results from your inquiry, your information is retained for a maximum of three (3) years in accordance with standard real estate record-keeping practices under BCFSA requirements.

Under the Personal Information Protection Act (PIPA, BC), you are entitled to:

• Know what personal information we hold about you
• Request access to your personal information
• Request correction of inaccurate personal information
• Withdraw consent to the collection or use of your personal information

We also use UTM parameters in URLs to measure the performance of marketing campaigns. This data is used internally and is not shared with third-party advertisers.

Program descriptions. Descriptions of seller programs on this website are summaries for informational purposes only. They are not contractual offers and do not constitute a binding commitment. All program participation is subject to an in-person assessment, mutual written agreement on price and terms, and eligibility confirmation.

Limitation of liability. Your Home Sold Guaranteed Program. Offered exclusively through Dominique Bandet PREC and not a program or policy of Sutton Group West Coast Realty. "Your Home Sold Guaranteed" and all guarantee language on this website is subject to a mutual written agreement on price and terms prior to listing. All guarantees are contingent on the seller maintaining the property in showable condition, agreeing to reasonable access during the listing period, and permitting execution of the approved marketing strategy. Eligible properties exclude leasehold title, fractional ownership, and vacant land. Program eligibility is confirmed at in-person assessment. Guarantees are paid or applied only upon successful closing unless otherwise specified in the written listing agreement.

Cancellation Guarantee. Applies prior to the receipt of any offer to purchase. Once an offer is received, standard listing agreement terms govern.

Your Home Sold Guaranteed — Commission Waiver. "Free" refers specifically to the listing-side commission of Dominique Bandet PREC for the extended term only. Buyer agent compensation and applicable marketing costs remain the seller's responsibility and are not included in the waiver.

Full Market Value Guarantee. Requires a mutually agreed written price range at listing. Commission reduction applies up to the maximum of the listing-side commission due to Dominique Bandet PREC. The guarantee excludes any buyer agent compensation.

60-Day Sold or Free Program. Requires an in-person assessment and mutual written agreement on price and terms prior to listing. "Free" refers specifically to the listing-side commission; buyer agent compensation and marketing costs still apply. Full program conditions reviewed at consultation.

Cash Offer Program. Cash offers are facilitated via a third-party buyer and are subject to independent inspection, buyer approval, and mutual valuation. Offer timeline begins following an in-person viewing of the property. Not a purchase offer from Dominique Bandet PREC or Sutton Group West Coast Realty.

This Policy is governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, including the Personal Information Protection Act (BC) and the Personal Information Protection and Electronic Documents Act (PIPEDA) where applicable. Any disputes arising from this Policy shall be subject to the exclusive jurisdiction of the courts of British Columbia.
